(US-NY) Legislation Introduced About Privacy Issues Around Criminal DNA Profiles (IAJGS Public Records Access Alert) – May 29, 2021 – DNA Saturdays May 29, 2021

I saw this recently on IAJGS(US-NY) Legislation Introduced About Privacy Issues Around Criminal DNA Profiles (IAJGS Public Records Access Alert): https://www.nysenate.gov/legislation/bills/2021/S1347. Much longer article. but here are some of the relevant portions.

Legislation in New Yok State has been introduced over privacy concerns with the municipal DNA identification indexes. The proposed law would create a single state-run index and requires municipalities to expunge any DNA records stored in a municipal DNA identification index within 90 days of the bill becoming a law.  DNA provided as part of an investigation is subject to expungement following dismissal of charges or non-criminal adjudication; no person other than a designated offender shall be required to provide a DNA sample for inclusion in the statewide DNA identification index;

The bill becomes effective immediately upon signature of the governor.

SB 1347 may be accessed at: https://www.nysenate.gov/legislation/bills/2021/S1347.  The Assembly version of the bill is A6124 https://www.nysenate.gov/legislation/bills/2021/a6124
