Wow this would be huge what the verdict will end up being

My educated guess is Ancestry will lose. I doubt Ancestry thinks it won’t lose, but unless they had permission from the yearbook companies who wouldn’t have filed a lawsuit if they gave it.
This could also affect other companies that have done the same thing with yearbooks if they didn’t get permission from the copyright holder.
